Abstract:
Whether copyright is property continues to ignite passionate debate more than 300 years after the entry into force of the Statute of Anne. While misinterpreting the consequences of the property attributes of copyright may lead to its unwarranted expansion to the detriment of users and the public domain, distancing copyright from property for fear of expansionism is problematic from a legal and normative standpoint. Professor Chapdelaine's analysis leads her to observe that copyright embeds two distinct proprietary interests from which the limitations of copyright holders' rights appear more sharply.
