Intellectual Property Law for Creative Entrepreneurs Certificate

This certificate is offered in partnership with OCAD University School of Continuing Studies. 

In today's innovation economy, intellectual property literacy is essential knowledge for artists and designers to understand their legal rights. Both the Federal Government's National IP Strategy and the Ontario IP Plan have identified the need for more IP education across the post-secondary system. The certificate explores copyright law, industrial design law, graphic design law, trademarks, IP law strategy, and Indigenous IP law. This certificate fills a gap in IP education and will be uniquely positioned to offer content tailored specifically to Ontario's creative entrepreneurs. This certificate is not for university degree credit. It was developed in partnership with the Faculty of Law, University of Windsor and eCampus Ontario.

QUALIFICATIONS

  1. Instructors assess the student's work and issue a grade of pass or fail. Students must receive a passing grade in the course for the course to qualify for the certificate.
  2. Students must complete four (4) distinct qualifying courses within three (3) years. 
  3. Successfully completed courses can be applied towards one (1) certificate only.
  4. When students have completed all certificate requirements within the prescribed time limit, they will be able to download a printable PDF file of their certificate from OCAD U.

In this online course, developed in partnership with the Faculty of Law, University of Windsor and eCampus Ontario, students are introduced to the most common forms of Intellectual Property law for the creative industries, such as copyright law, industrial design law, graphic design law, and trademarks. The course also introduces IP strategy, exploring how different forms of IP can be leveraged by entrepreneurs as business assets. The course empowers creative professionals with an understanding of their legal rights, so they may advocate for themselves and engage in informed discussions with legal professionals.

Learning Outcomes
Upon successful completion of this course, students will learn:

  • The meaning of intellectual property and the policy behind recognizing IP rights in the first place,
  • To identify the most common forms of IP and be able to single-out those most relevant to the creative sector,
  • The concept of IP strategy as essential for the effective commercialization of creative expressions (sharing and selling creative works),
  • The basic legal principles surrounding IP ownership,
  • The need to determine third party IP rights and freedom to operate.

Upon successful completion of this course learners will receive a Certificate of Completion. This course requires a series of assignments and learners will be assigned a grade of "complete or incomplete".

Building on the knowledge gained in Introduction to IP and IP Strategy for Creative Entrepreneurs, this course, developed in partnership with the Faculty of Law, University of Windsor, Gilbert’s LLP, and eCampus Ontario, explores the basic principles that underlie copyright protection and distinguish between copyright rights and moral rights under Canadian law. Students are introduced to the general scope of rights afforded by the Copyright Act, and how it applies to creative industries. The course addresses how copyright protection is obtained and registered, copyright infringement, understanding the concept of ownership in copyright, and also discusses how copyright can be exploited in different ways, including licensing. Students are shown different examples of commonly used “open licenses” in the creative and tech industries. The course examines how copyright applies in practice, with a focus on copyright issues commonly encountered by entrepreneurs and small to medium-sized businesses. The course empowers creative professionals with an understanding of their legal rights, so they may advocate for themselves and engage in informed discussions with legal professionals. 

Learning Outcomes 
Upon successful completion of this course, students will learn: 

  • The basics of copyright law including the source of law and the basic legal framework, 
  • Fluency in copyright law concepts and terminology, 
  • The basic scope of protection provided by copyright law and how it applies to a variety of works, 
  • The general mechanisms behind copyright ownership, transfer of ownership, and licensing.

Building on the knowledge gained in Introduction to IP and IP Strategy for Creative Entrepreneurs, this course, developed in partnership with the Faculty of Law, University of Windsor, Gilbert’s LLP, and eCampus Ontario, explores the law of industrial designs from a practical perspective, including how this body of IP can be used strategically to achieve entrepreneurial objectives. The course provides a wholistic view of what an industrial design is, the exclusive rights that attach to a registered industrial design, and how an industrial design is situated in respect to other forms of intellectual property. The course also examines practical aspects including how an industrial design can be utilized in a business setting, how an industrial design is registered, how the rights in an industrial design can be enforced, and how protection through industrial design is obtained in jurisdictions outside of Canada. The course empowers creative professionals with an understanding of their legal rights, so they may advocate for themselves and engage in informed discussions with legal professionals. 

Learning Outcomes 
Upon successful completion of this course, students will learn: 

  • To understand what an industrial design is and recognize when they might have a design that could be registered in Canada, 

  • To determine if registering their design, as opposed to or in addition to a different form of intellectual property, will assist in achieving their entrepreneurial objectives, 

  • To register a design with the Canadian Intellectual Property Office, 

  • The available options and implications of enforcing the rights in their registered industrial designs.

Building on the knowledge gained in Introduction to IP and IP Strategy for Creative Entrepreneurs, this course, developed in partnership with the Faculty of Law, University of Windsor, Gilbert’s LLP, and eCampus Ontario, explores trademark law. Students learn how to align their trademark strategy with branding strategy and how to protect trademarks in Canada. Topics include trademark basics and history, acquiring trademarks, commercializing trademarks and selling a brand, protecting trademarks including domain name disputes, and special topics and emerging trends in trademark law such as Artificial Intelligence (AI). The course empowers creative professionals with an understanding of their legal rights, so they may advocate for themselves and engage in informed discussions with legal professionals. 

Learning outcomes
Upon successful completion of this course, students will learn: 

  • The basic legal principles, history, and policy rationale for trademarks, 
  • The administrative process for obtaining a registered trademark, including trademark searches, selection and classification of goods and services, and the Canadian trademark prosecution process, 
  • To recognize the inherent value of trademarks, and the ability to generate goodwill, reputation and business by implementing a sound trademark strategy, 
  • The best practices to protect trademarks, 
  • The differences between registered and unregistered trademarks, as well as the different forms of trademarks.

This course is offered in partnership with OCAD University School of Continuing Studies   

This course, developed in partnership with the Faculty of Law, University of Windsor, Ridout & Maybee LLP, and eCampus Ontario, will explore Indigenous IP law, focusing on Indigenous knowledge and cultural expression (IK&CE). Students will learn to acknowledge the value of IK&CE and identify benefits of protecting and defending IK&CE to non-Indigenous and Indigenous creators and knowledge keepers within Indigenous communities. This course is about starting a conversation and bringing attention to misjustice stemming from the Western IP system to Indigenous peoples through the way each nation practices its laws. Please note this course does not speak on behalf or claim to be knowledge keepers for any First Nations, Inuit, or Métis peoples. 

Learning Outcomes
Upon successful completion of this course, students will learn: 

  • To identify the impact of the Western IP system on Indigenous communities and the protection of IK&CE (including misuse and misappropriation), 
  • To describe different global approaches to protect IK&CE and possible applications to IK&CE in Canada, 
  • To cultivate an appreciation for different approaches to protection of knowledge within Indigenous communities to support improved relationships between non-Indigenous and Indigenous creators and knowledge keepers, 
  • To develop respect for working with, creating, viewing, and sharing IK&CE.
